Rule 6
Examination and recommendation on petitions
: (1) Upon examination of petitions received according to Rule 5, the concerned prison found that the behavior of the prisoner has improved, the imprisonment period to be paid according to Section 37 of the Act, and the imprisonment period has been paid according to Section 37 of the Act and this regulation. If it is found that deduction is possible, the application received and the documents attached to it and the records related to the movement of the concerned prisoner kept as per rule 4 should be attached and submitted to the Chief District Officer of the concerned district along with his recommendation.
(2) According to sub-rule (1), if it is found that the behavior of the prisoner applying for commutation of imprisonment has improved and the prisoner's sentence can be commuted according to the Act and these regulations, the concerned Chief District Officer shall open the same proceedings A recommendation should be made before the department in the format as per schedule-3 for imprisonment. (3) Upon examination of the application with recommendations received under sub-rule (2), if it is deemed appropriate to reduce the imprisonment of the offender in accordance with the Act and these regulations, the department shall prepare a summary statement and send it in writing to the Ministry for a decision to reduce such imprisonment.
(2) According to sub-rule (1), if it is found that the behavior of the prisoner applying for commutation of imprisonment has improved and the prisoner's sentence can be commuted according to the Act and these regulations, the concerned Chief District Officer shall open the same proceedings A recommendation should be made before the department in the format as per schedule-3 for imprisonment.
